can any of BRC statements be out of scope?

What do you mean? Do you mean that some of the BRC requirements don't apply to you? Explain and we might be able to help.

If you can demonstrate that a particular section does not apply to you then yes.
But it would be highly doubtful that in practice this would occur.

However, there maybe certain clauses that don't apply
eg 5.2.1.5 regarding claims. If you make no claims, then this clause won't affect you. but the clauses before may do.

If we don' t have any allergens containing material this have to be documented?

It would have to be documented.

So woulod your nut policy. And any other policy to ensure employees do not bring allergens in to your premises.

YES. You can exclude some of your products of your plant because it is not for retail consumers. That wont be part of the certificate.

You can not exclude any clause of the BRC. All elements of the standard must be applied to the scope. Where and activitiy is not applicable, should be justified. (e.g. Design and Development processes, allergens, subcontracted processes, etc.)
