Food contact approval for poly bags

Hi

 

In Canada, our govt used to approve food contact packaging materials and made a list we could reference. They have now stopped this, and have requested that companies that "prove the food contact materials are safe- letters of guarantee, science etc".  In saying this, when looking into new food contact materials (in this case poly bags for fish)- we often need to buy from US companies.  US companies cannot seek Canadian Govt approvals anymore so they will ask if we will accept a letter of guarantee instead. I am not sure what to look for in a letter from the FDA. I have attached one I received- can anyone comment if this would verify compliance to FDA regulations or if I should ask for more?

I'm assuming your needing this info for export and not solely domestic use?  I know that letter example you've provided will suffice for CFIA, I would assume should also suffice for exports to the US.

Yes, we sell to both Canada and USA.

Letters typically look like:

 

This material complies with requirements for food contact packaging in the code of federal regulations title 21.

 

-Signature

 

Sometimes they can reference specific approved processes as well or a letter of no objection.

I agree, you should request for a letter stating title 21. 

 

I comply with title 21 parts 175-178 for food contact materials for products sold in the US. 

 

for example: 

 

All items manufactured for CUSTOMER, by COMPANY meet or exceed all FDA requirements.

 

All material produced complies with the requirements of parts 175 – 178 of title 21 of the code of federal regulations.

As support you should also print out CFR Title 21 for your files.

We purchase poly bags and receive letters from the supplier ~

Dear JXX,
Please be advised that all Poly bags manufactured and supplied by XXX, are made from 100% virgin Linear Low Density Polyethylene and Low Density Polyethylene, and based on the resins and practices used; our products are cleared for the use in articles or components of articles intended for contact with food under 21 CFR 177.1520© (3.1) (olefin polymers) regarding the use of polyethylene with food contact articles and meets the specifications in that paragraph.
This letter also certifies that BPA (Bisphenol A) are not present in any of the material used in the manufacturing of bags and film. All resins and additives being used are safe for direct contact with Food. Technical Data Sheets, Safety Data Sheets and FDA approved letters from our resins and components suppliers are also attached for additional information.
It is the responsibility of the user to assess its product uses and applications and assure conformance to all applicable laws and regulations.
If you have any questions or require further information, please contact us at xxx
