ISO 22000 NC related to lack of legislation register and link to product and FSMA

We recently had a gap audit conducted, the auditor raised an NC against the FSMS scope, It was admittedly a little wooly, which I have now addressed. He also added an NC related to this regarding reference to legislation (see below) I have scrutinised clause 4.3 of the standard and cannot see where this is a requirement.  Is there something I am missing, or is it noted somewhere else in the standard,

any advice would be appreciated.

 

NC2 - There should be a legislation register that contains relevant regulatory and statutory information and how that applies to the products made and the FSMS. For example, this may include 10/2011, 1935/2004 or 2023/2006

Was your auditor referring to ISO 22000:2018? I couldn't find this requirement in the standard...

Yes the gap was against iso 2200:2018, I couldn't see it either, but thought maybe it was somewhere else other than clause 4.3

I've checked in the whole standard - nothing. Not in the Additional Requirements as well

What makes noice is the "should"....

 

Either is shall or it is not// there are no more OFI in the standard

Actually, Its not NC ,cause of organization only can determine what interested parties and issues that can affect according to context and scope , on the other hand we can consider it as recommendation or opportunity for improvement , As we can not consider it as a potential point once if auditor consider it as NC clause of NC will be 4.2
