Just wrapped up level 3 cert audit. Auditor documented major non-conformance due to comnpany receiving a regualtory warning letter in early 2013. Per Part A 5.03 of Edition 7.1 suppliers are required to report any warning letetrs as well as class 1 & 2 recall to the cert body. Discussed the fact that edition 7.1 was not effective until 7/1/13 post receipt of the warning letter. Auditor's stance is that Edition 7 was interpreted to include warning letters as a "regulatory infringement".

Curious if anyone familiar with Edition 7 interpreted this clause to mean that any regulatory infringement other than class 1 & 2 recalls required notification of cert body?

The standard says, " Upon identification that a certified supplier initiates a food safety event that  requires public notification (such as a Class 1 or Class II recall)....   While warning letters are often public, they aren't always nor do they necessarily require public notification.   Did the warning letter require public notification?  If the warning letter was still being dealt with then think it is a gray area, however if you had already resolved the issue before the code took effect, think auditor is being overly stringent.

So, I'm not getting this Chris. If I read what you wrote correctly you just went thru your FIRST certification audit in September or October of 2013 and this warning letter you received was before you were an SQF "certified" supplier?

 

If that is the case, the Auditor is wrong.
