5.1.6 Nutritional Claims

We do not make any nutritional claims, per say.  We do have products that state "gluten free".  Would this be considered a nutritional claim and covered by 5.1.6? Or would the "gluten free" claim fit into another clause?

Gluten free is not a nutritional claim. Gluten free is an allergen free claim. Look in BRC section 5.2 Management of Allergens.

which standard with 5.1.6?

 

Acc to EC-law "gluten-free" statement is not a nutritional claims. All excepted nutrional claims are listed in annex 1 of regulation 1924/2006. Mesophile gives the correct indication: it is a statement with respect to allergens (EC regulation 41/2009). Products have to meet levels of gluten.

In the US I don't know in detail, but it should be the same (the limits are different)
