Legislation Statement – how to keep up to date?

Hi, As part of our BRC requirements we have a leglislation statement listing leglislation we adhere to. I don't know a lot about this area and our auditor has pointed out that our list is very outdated and includes acts which are no longer in force and misses out some we should really have down. Somehow it has fallen down on me (the clueless) to redo this list.

Does any one know what the vital leglislation is that I should be listing (and reading of course) so far I have

* EU regulation 2073/2005 microbiological criteria for foods

* Codex Alimentarius

* The food information act No 1169/2011

* The general food law regulation 178/2002

* The food safety act 1990

* The food safety and hygiene (England) Regulations 2013.

 

The allergen regulations and OM regulations are referenced on other documents.

Dear Nikki,

 

In addition to the comments above, try to obtain and to mention the chapters which are specific to your products. What you have right now is framework legislation and that is not detailed enough.

 

So for example: if you use additives, you put in the concerning additive chapters. If you label your product, put in the labelling legislation etc. If you sell your products with a specified weight, these are subject to the product quantity declaration legislation. Etc... until you have gathered all the specific chapters.

EU Regulation 852/2004 on the Hygiene of Foodstuffs

Microbiological Criteria for Foods EU Regulation 2073/2005

The Food Labelling Regulations  1935/2004

The Food Additives, Flavourings, Enzymes and Extraction Solvents (England) Regulations 2013

BRC Global Standard Food Safety – Issue 7

Commission Regulation (EU) NO 10/2011 on plastic materials and articles intended to come into contact with food.

 

I think I am there but can anybody see anything vital I may have missed? Also does anybody know if the is a fifth edition of the codex alimentarius. I read somewhere last year that they were working on a fifth edition but can no longer find any mention of it on the internet anywhere.

Please see below list of regulations you may find useful. I include these in our HACCP scope - is that what your auditor picked you up on?

 

 

1.          Recommended International Code of Practice. General Principles of Food Hygiene. CAC/RCP 1-1969, Rev. 4-2003. Joint FAO/WHO Food Standards Programme CODEX ALIMENTARIUS COMMISSION.

 

2.          HACCP A Practical Guide 5th Addition (Campden BRI 2015)

 

3.          Food Safety and Hygiene (England) (Amendment) Regulations 2016

 

4.          Materials & Articles in Contact with Food (England) Regulations 2012.

 

 

5.          COMMISSION REGULATION (EC) No 2023/2006 of 22 December 2006 on good manufacturing practice for materials and articles intended to come into contact with food

 

 

6.          COMMISSION REGULATION (EC) No 1881/2006 of 19 December 2006 setting maximum levels for certain contaminants in foodstuffs

 

7.          The Weights and Measures (Packaged Goods Regulations) 2006

 

 

8.          COMMISSION REGULATION (EC) No 1441/2007 of 5 December 2007 on microbiological criteria for foodstuff

 

 

9.          REGULATION (EC) NO 396/2005 OF THE EUROPEAN PARLIAMENT AND OF THE    COUNCIL of 23 February 2005 on maximum residue levels of pesticides in or on food and feed of plant and animal origin

 

10.          The Water Supply (Water quality) Regulations 2016

Also, create a hyperlink for each legislation as you may be asked by auditors to have a look at them.

Thank you Yas, This is where I auditor picked us up on. The list created by my manager was full of obsolete legislation which included health and safety and trading standards. Apparently this list was created 13 years ago and not updated. As our internal auditor I have no idea what should have been included and passed it as the hyperlinks worked and he is the "Expert". We were saved from a non conformance by the fact that when I wrote procedures I reference the leglislation in the procedure. Not sure we could get away with it again though as she pointed it out :shutup:
