FDA ruling for the requirement for footnote on nutritional label?

Hello,

Is anyone familiar with the ruling for the requirement for footnote on nutritional label? Verified the FDA ruling papers and it is no so clear if it is a requirement for ALL food or if for labels that are < 40 sq.in, the footnote can be completely omitted (including just the statement saying " Percent daily values (DV) are based on a 2,000 calorie diet).

As we are reviewing our labels, I noticed that some of them do not indicate nothing, not even the statement.
