Does a non-retail product require a Prop 65 warning on our labeling?

For whole sale of a product that is more likely to be repacked and/or used as an ingredient for a product to be sold retail in CA. Do we need to use the Prop 65 warning on our labeling? We are in NM.

If you are selling / distributing product into California and you have an ingredient that is on the Prop 65 list above the threshold level then yes according to the regulation.

 

Now...in practicality maybe not; ask the coffee companies who sell & distribute in California because of trace amounts of acrylamide.
