Labeling rules and online sales in Canada

Hi all,

 

One of our distributor let us know that regarding products sold online, if all information requested on the labeling are displayed on the website page where the product is sold, they could send the product in "blank" packging (with only lot number and BBD printed on it).

 

I can't find a legal reference on this specific rule.

 

Do one of you guys know if their statement is true, and what is the specific regulation allowing this ?

 

Products are grains, cookies and cereal-based dry products.

Consumer Packaging & Labeling Act, Canada, page 3:

Prohibitions

Prohibition respecting labels
4 (1) No dealer shall sell, import into Canada or advertise any prepackaged product unless that product has applied to it a label containing a declaration of net quantity of the product in the form and manner required by this Act or prescribed and in terms of either
(a) numerical count, or
(b) a unit of measurement set out in Schedule I to the Weights and Measures Act, as may be prescribed.

So it seems there is no exemption regarding the declaration of net quantity. But what about the other labeling requirement under the SFCR and FDR ?

E.g. product names, ingredients, nutritional table, etc.

Most prepackaged foods sold in Canada require that a label be applied or attached to it [B.01.003, FDR; 214, 217, SFCR]

I saw this page in the past and nowhere inside is mentioned any exemption regarding the selling of product online.

It may be a mistake from the distributor, but it seems strange to me, as it's a fairly well known seller in the province of Québec, and they are used to sell product in blank packaging (because the label is visible on the website).

 

Maybe it could be an exemption from the MAPAQ, and specific to the province of Québec ? They are not able to give us any source on their statement.

 

 

Anyway, if I don't find any proof, we will keep to use our regular packaging with label when working with them.
