Listeria for cook-in package

Hello, we manufacture RTE puddings that are sealed-pasteurized-cooled. Are we excluded from the Listeria policy then because there is no post-contamination after the pasteurization step? Most of them are packaged in plastic tubs with a top film. Occasionally we find leakers, but no equipment is perfectly designed to have a 0% leaker rate. So what does this mean? Do we take or not take this into consideration when accessing whether there could be post-contamination or not?

Yes excluded.  Of course,  you want to have a seal integrity monitoring SOP.
