Is an Ice Cream Cake Manufacturer regulated by FDA or USDA?

Hi everyone, if I am a ice cream cake manufacturer who purchases prepared ice creams and cakes to assemble/ cut into ice cream cakes, would I be regulated by the FDA or the USDA? Thank you!
