Regulation CE 852/2004 scope

Hi,

I would like to know if  Regulation CE 852/2004 is applicable to a food additive manufacturer provided in the regulation scope is stated that is applicable to all stages of production of food.

Yes, it does apply.

As per Article 2(2) of 852/2004: "The definitions laid down in Regulation (EC) 178/2002 shall also apply."

Referring to the definition of "food" in 178/2002:

For the purposes of this Regulation, "food" (or "foodstuff") means any substance or product, whether processed, partially processed or unprocessed, intended to be, or reasonably expected to be ingested by humans. "Food" includes drink, chewing gum and any substance, including water, intentionally incorporated into the food during its manufacture, preparation or treatment. (continues in more detail about water, and specific exceptions)

 

For the purposes of these regulations, additives are therefore a "food" and within scope.
