Does bioengineered food disclosure include FDA inspected items?

Does BE Food disclosure apply to USDA inspected items only or does this include FDA inspected items? If we have FDA exemption on Nutrition Facts labeling as a food manufacturer due to business size with employees and sales quantity, then are we exempt from BE disclosure also?
