If a product contains less than 2% soybean oil does the label have to state that it contains soy?

Hello, 

 

If a product contains less than 2% soybean oil does the label have to state that it contains soy?

I am not sure it is highly refined.

Short answer, yes.  Long answer maybe not?

 

If a product contains any amount of an allergen it must be declared.

 

Some soybean oil is highly refined and contains no soy proteins and thus does not qualify as an allergen.  Speak with your supplier about the product you're purchasing.

Yes, per FALCPA food labels must declare the presence of a major food allergen as defined per the FDA. The only exemption may be if the ingredient does not contain the allergenic protein but in your case of a soybean oil the allergenic protein would still be present and must be declared.

Be careful with highly refined oils.  FDA may agree that there is no protein, but the USDA does not necessarily agree with the FDA.  So it all depends on what jurisdiction your product falls under.  Understand those rules.
