Can I do protein powder packaging and bagging business at home?
Hi everyone,
This is my first post on this website, and I hope I am posting my question in the right place.
I am wondering if it is possible to buy protein powders in bulk (44-pound bags) from known factories, then split them into smaller packages (1-2 pounds) at home and sell them on Amazon or in local stores. Are there any regulations or certificates that I need to obtain to do this in the USA (especially in California or Nevada)?

You'd need a license from your local public health for sales within your state---if i'm not mistaken, you cannot sell cottage industry (which is what this would be called) food across state lines

Scampi is correct for multiple reasons. Selling on-line, Amazon, does mean you cross state lines which requires more regulation. Supplement industry is different but to sell food items - a licensed kitchen is required.
Cottage industry laws may not cover protein powders. Contact your local health department or the land grant University extension office. They will have the knowledge and expertise on local/state laws.
If you were actually making the product and and packaging it for sale you can qualify under your state's cottage regulations and you'd just have a permit from them and a BOH inspection by your town or county - but then you would only be able to sell within your state.
Since you are taking a bulk product in and re-packaging it you would not qualify under the majority (if not all) of cottage operations because you are not making the product yourself.
So, unfortunately bottom line - no not possible.

I have actually dealt with one of these operations before. They do exist, but they generally are at a higher scale. A legitimate co-packer with a proper facility could do this for you legally, but I'd doubt it would be profitable.
I do see where you are going with this, but it probably would make more sense for you to just start making protein powder yourself, do a few years of research, maybe work somewhere in the industry, then find a good co-packer once you've got a plan and a business loan together.
I have seen some very small mom and pop protein powder companies. They do exist, but you need someone with facility to make your product.
