Legal Concerns Around Spain’s 2024 Border Control Reform

In Spain, in 2024, a reform of the official control system for imported foods took place.

The reform consists of transferring the administrative competence of control from the Ministry of Health to the Ministry of Agriculture.

It involves coordinating the controls from a single Ministry, so that a single Ministry exercises all the competences: controls on animals, plants and food.

The legal form chosen to carry out this restructuring has been through a Ministerial Order.

The assignment of the function of border control of imported foods to the Ministry of Health was done through a legal regulation with the rank of Law.

The restructuring through a Ministerial Order could create problems of legal uncertainty.
