WE sell a pack of frozen salmon, on the package it states that the pack contains 4 portions with a total weight of 800g. due to some issues with machinery we are having issues getting 4 portions to weigh up properly. we are having a lot weighing in at just under the 800g.  Can we legally put 5 portions into the pack?

I'm not sure of Australian legislation on this, hopefully an expert will be along soon.  But in the UK piece counts are normally a minimum to allow for this situation, e.g. "contains minimum 4 pieces".

 

Legality aside, differing sizes will have an impact on cooking times so once you have your answer on the legality, you might want to see how the times you put on pack negatively impact quality for your smallest pieces or could result in undercooking for your largest ones, just to make sure that you're not going to end up with complaints, or worse, consumer illness.

This is where you will find your answer           it would seem you can sell by weight OR unit count, not both
